Jennifer L.L. Gant

Biography

I am currently the postdoctoral research fellow on the European Justice Programme funded Judicial Co-Operation supporting Economic Recovery in Europe (JCOERE) project intended to identify obstacles to judicial co-operation presented by the implementation of the proposed preventive restructuring directive. JCOERE will focus on the strengthened co-operation obligations imposed on the judiciary in the Recast Regulation but will confine its enquiry to preventive restructuring processes. In addition to exploring challenges that procedural rules might present to co-operation, this project will focus on specific substantive problems that will likely become more acute in the restructuring context, such as the commencement of secondary proceedings to protect a creditor’s interests in the face of the ‘cram-down’ provisions as envisaged by the Directive. The question of whether it is reasonable for a court in the second state to decline jurisdiction becomes more immediate in such circumstances. Radical restructuring processes may make co-operation more difficult which may, in turn, inhibit restructuring in the EU.

I completed my PhD at Nottingham Trent University, Nottingham Law School in 2016, following which I was a lecturer teaching contract and commercial law and critical legal thinking on the undergraduate course and specialising in insolvency law as it intersects with employment law and social policy on the masters programme. 

I am on the board of INSOL Europe Academic Forum and the chair of the Younger Academics Network of Insolvency Law. I am also the editor of the INSOL Europe Annual Conference Proceedings Booklets. 

My research interests include insolvency and corporate rescue, corporate law, comparative law, social policy, employment and labour law, legal history, legal theory, and contract and commercial law.
