Mary Donnelly

Mary Donnelly is a graduate of University College Dublin (BCL 1986), University College Cork (MA 1993), Trinity College Dublin (MLitt 1995), University of Wales, Cardiff (PhD 2007). Her books include The Law of Banks and Credit Institutions (Dublin: Round Hall Sweet and Maxwell, 2000); Consent: Bridging the Gap Between Doctor and Patient (Cork: Cork University Press, 2002); Healthcare Decision-Making and the Law: Autonomy, Capacity and the Limits of Liberalism (Cambridge: Cambridge University Press, 2010); The Law of Credit and Security (Round Hall, 2011; 2nd ed 2015) and  she is co-author of End-of-Life Care: Ethics and Law (Cork University Press, 2011) and Consumer Law: Rights and Regulation (Round Hall, 2014) and co-editor of Ethical and Legal Debates in Irish Healthcare: Confronting Complexities (Manchester University Press, 2016) . She has collaborated on projects funded by the European Commission, the Irish Research Council for the Humanities and Social Sciences, the National Children's Office and the Irish Hospice Foundation and has acted as consultant for public agencies and legal firms. She was a member of the Expert Group to review the Mental Health Act 2001 (2013-2015) and is a member of the Health Service Executive National Consent Advisory Group/Assisted Decision Making Steering Group. She is the Banking and Security correspondent for the Commercial Law Practitioner. She has served as External Examiner at Dublin City University and University College Dublin and is currently External Examiner at the National College of Ireland.  She was a visiting fellow at Monash University, Melbourne, Australia (2002) and at the London School of Economics (2009) and University College London (2016)

Research Interests


My primary research interests lie in medical/capacity law and consumer protection.  

In respect of medical/capacity law, my work relates primarily to the interplay between individual autonomy and state intervention/protection. My book, Healthcare Decision-Making and the Law: Autonomy, Capacity and the Limits of Liberalism (Cambridge University Press, 2010), critiques the elevation of aspects of the liberal conception of autonomy within medical law and  I am currently working on a monograph entitled Evolving Legal Responses to Impaired Capacity. I am also interested in the intersections between legal and medical systems and the consequences of legal involvement for medical practice. One part of this ongoing project is a jointly edited collection of  essays entitled Ethical and Legal Debates in Irish Healthcare: Confronting Complexities (Manchester University Press, 2016).

The substantial focus of my work in consumer protection is in financial services and in the digital environment. I am especially interested in developing critical evaluations of the effectiveness of consumer/borrower protection measures in practice.  The first edition of my book The Law of Credit and Security was published in November 2011 and the second edition in November 2015.  Working with Dr Fidelma White, I jointly authored the only detailed Irish treatment of consumer law: Consumer Law: Policy and Practice (Round Hall, 2014) and we are currently working on a monograph entitled Consumer Protection in the EU Digital Environment to be published by Hart Publishing in 2018.

Teaching Interests

In respect of all of my teaching, my primary goal is to encourage students to undertake a critical evaluation which draws on the realities of the law in practice.

The topics which I cover in my teaching include the following:

Medical Law: consent to treatment; informed consent; capacity; parental autonomy; decision-making for childen and adults lacking capacity; end-of-life decision-making.

Financial Services Law: the regulation of financial services provision, including consumer protection; banking law; insurance law and investment law

The Law of Credit and Security: regulation of credit providers; consumer credit; lending practice and responsible lending requirements; forms of security; debt enforcement

eCommerce Law: regulatory and consumer protection issues in online financial services marketing and provision. 


In addition, I was the Director of the LLM Degree from 2001-2009 and am currently the Director of the LLM (General) Degree.  As part of this, I teach Legal Research Methods and Writing for LLM students.  I also teach oral presentation skills at LLM level.  This involves videotaping of students' presentations and giving detailed individualised feedback to students regarding how to develop their skills.
