Conor O'Mahony

Biography

Professor Conor O'Mahony is a graduate of UCC (BCL 2001, LLM by Research 2002) and the University of Wales, Aberystwyth (PhD, 2005). He has lectured in UCC since 2005, and is currently the Vice-Dean for Research in the School of Law. He is the Director of the Child Law Clinic at UCC, through which he works to support litigation concerning children and to advocate for law reform in the area of child law. From 2019 to 2022, he served as Special Rapporteur on Child Protection to the Government of Ireland.

Professor O'Mahony's research interests lie broadly in the areas of constitutional law and child law, with a particular focus on family and children's rights. He is the author of Educational Rights in Irish Law (Thomson Round Hall, 2006) and has published articles in such international journals as the International Journal of Constitutional LawPublic Law, the Human Rights Law Review, the International Journal of Children's Rights, the Harvard Human Rights Journal, the International Journal of Law, Policy and the Family, the Journal of Social Welfare and Family Law, the Child and Family Law Quarterly, the International Journal of Children's Rights and Children and Youth Services Review. He has delivered papers at conferences in eleven different countries. He has been invited to provide expert testimony to various Oireachtas Committees  as well as the Constitutional Convention and the Citizens’ Assembly, and contributes regularly to analysis in the national media.

Past projects include the 
Child Care Proceedings in the District Court, which was awarded the UCC Research Team of the Year Award for 2016; IDEA: Improving Decision for Children through Empowerment and Advocacy - a two-year, five country project which received €420,000 of funding from the European Commission; the Voluntary Care in Ireland Study, which was one the first empirical investigations internationally of the protection of the rights of children and parents in voluntary care agreements; and FYDO – Facility Dogs in Europe, which piloted the use of facility dogs as a means of mitigating secondary victimisation for vulnerable victims and witnesses of crime (including children) during their contact with the justice system.

Professor O'Mahony currently supervises five PhD projects in the broad areas of constitutional law and child law. Unfortunately, he does not have capacity for additional supervisees at this time.

 Description

Director of the UCC Child Law Clinic, which delivers research assistance to legal practitioners engaged in cutting-edge litigation on children's issues at all levels in the courts, from the District Court to the European Court of Human Rights. Between 2009 and 2014, I was heavily involved in Louise O'Keeffe's successful application to the European Court of Human Rights, which resulted in a judgment against the Irish State for failing to implement adequate child protection measures in primary schools. Subsequently, I led the Clinic's work advocating for improvements to the redress scheme established by the Government in response to the O'Keeffe decision, ultimately securing a ruling in 2019 that the scheme was incompatible with the terms of the ECtHR judgment.

I am a regular media analyst on legal affairs in both the broadcast and print media, including the Irish Times, the Irish Independent, the Irish Examiner, TheJournal.ie, RTE (The Week in Politics, Morning Ireland, News at 9.00. News at 1.00, Drivetime, This Week), TV3 (Tonight with Vincent Browne, Ireland AM), Newstalk 106 FM (Breakfast, The Pat Kenny Show, Lunchtime, Moncrieff, The Right Hook, Global Village, The Shane Coleman Show) and Today FM (The Last Word). I have written over 30 op-ed articles and given over 200 broadcast interviews.

I actively engage on law reform issues through providing oral testimony and written submissions to Oireachtas Committees and other reform bodies. In 2012, I was one of the invited panel members at the Constitutional Convention session on Marriage Equality, pursuant to which a recommendation was made (and accepted by Government) to hold a referendum on whether the Irish Constitution should be amended to guarantee marriage equality. In 2018, I was invited to address the Citizens' Assembly as part of its deliberations on the reform of the referendum process. I have been invited to provide expert testimony to the Oireachtas Committee on Health and Children (2015) and the Oireachtas Committee on Justice and Equality (2019). I have played an active role in campaigns and public debate in the referendums on Oireachtas Inquiries (2011), Children's Rights (2012), Seanad Abolition (2013) and Marriage Equality (2015).

In 2019, I was appointed Special Rapporteur on Child Protection by the Irish Government for a three-year term. The terms of reference of the Special Rapporteur are as follows: 1. The Rapporteur shall, in relation to the protection of children and on the request of the Minister for Children and Youth Affairs: - Review and report on specific national and international legal developments for the protection of children; - Examine the scope and application of specific existing or proposed legislative provisions and to make comments/recommendations as appropriate; and - Report on specific developments in legislation or litigation in relevant jurisdictions. 2. The Rapporteur shall report on relevant litigation in national courts and assess the impact, if any, such litigation will have on child protection. 3. The Rapporteur shall prepare, annually, a report setting out the results of the previous year’s work in relation to 1) and 2) above. 4. The Rapporteur will provide, if requested by the Minister, discrete proposals for reform, prior to the submission of the annual report. 5. The annual report of the Rapporteur will be submitted to the Government for approval to publish and will be laid before the Oireachtas and published.
