Doli Incapax

Abstract

In this article, the author considers doli incapax. This obscure doctrine of ancient origin provides a presumption that children over the age of criminal responsibility but under a certain age are presumed incapable for committing a criminal offence. The author examines the consequences of this legislative amendment in New Zealand child offender laws, along with its application and relevance in contemporary New Zealand criminal law.
