Abstract
This article examines, the manner in which the right of freedom of association enshrined in Article 40.6.1.iii. It is divided into two parts. Part i outlines the textual basis of the right, its historical development and its nature and scope understood within a unique constitutional context: its scope, relationship with international law, limitations, and relationship with other rights. Part ii then considers some of the rationales for respecting, protecting and promoting freedom of association. It seeks to outline and map the key underpinnings of the approach of Courts, the legislature and scholars when engaging with the right.
