Abstract
Recent developments in the Netherlands and Ireland in corporate restructuring raise questions regarding jurisdictional competition and the consequences of this phenomenon. The 'race to the bottom' debate which emerged in US literature during the 1990s, does not capture the entire effect. This chapter argues that cross-pollination of legal systems through pro-active European harmonisation projects, together with sharing of knowledge and expertise will add to European expertise as a whole, with positive effects far outweighing any negatives.
