THE INSANITY DEFENCE IN IRELAND: AN ANALYSIS OF THE DEFENCE IN HOMICIDE TRIALS

Abstract

There is a lack of detailed research into the insanity defence in Ireland. No previous studies have identified how frequently the defence is being used when compared to other countries or other defences. This article presents research from a 23-year period on how often the defence is raised compared to other criminal defences in homicide trials and its success rate. These statistics are compared with data available from England and Wales, where it is concluded that the defence is being utilised significantly more frequently in Ireland.
